When I submitted my County Charter Revision Intitiative to the County Clerk, the District Attorney was required by state law to write a ballot title, question, and a summary statement. He did so and I contested it on several points. The Judge sided with me on two points and upheld the District Attorney on the balance. What follows is the Court Certified ballot title, question, and summary:
BALLOT TITLE: Revision of County Charter
QUESTION: Should the Josephine County Charter be completely revised to provide for significant changes in County Government?
SUMMARY: This measure significantly changes the Josephine County Charter. The number of County Commissioners increases from three to seven. Voters elect commissioners from seven districts as determined by the Board of County Commissioners and Clerk. The Board meets weekly throughout the County to hear from department heads and citizens.
The measure changes the way voters elect all County officials. In the primary election, voters indicate "yes" or "no" for each candidate. Candidates receiving more than 50% "yes" votes run in the general election. The candidate in the general election receiving the highest number of votes wins. County Counsel is appointed. Annual salary and benefits for elected officials becomes $30,000. The measure prohibits voting on a tax by those not subject to that tax.
Current ordinances expire after the adoption of the Charter revision.
The measure declares rights of citizens and restrictions on County government, including the right to harm one's self by suicide, not wearing helmets and seatbelts and using addictive or toxic substances.
The measure repeals the previous Charter's support for animal control and libraries.
